Terms & Conditions

1. Introduction

Yimken (يمكن) is a digital marketplace and intermediary that connects vehicle owners in the Republic of Iraq with spare-part companies, workshops, event-decoration providers and crane (tow-truck) drivers.

By using the app or this website you agree to these Terms. If you do not agree to them, please do not use the service.

2. Eligibility and account responsibility

  • You must be legally capable of entering into contracts in Iraq to use the service.
  • You are responsible for the accuracy of your account details, for keeping your PIN or password confidential, and for all activity carried out through your account.
  • Your details must be accurate and current — especially your phone number, since it is the primary contact channel and the sign-in identifier.
  • Never share your verification (OTP) code with anyone. Yimken staff will never ask you for it.

3. Roles in the app

  • Customer — browses and orders parts and services, and requests a crane.
  • Company — lists and sells spare parts and manages its orders and offers.
  • Workshop / service provider — lists services and packages (including event-decoration packages) and receives bookings; it does not sell spare parts to customers through the app.
  • Crane driver — receives and performs tow requests.

Every new account starts as a customer account, and upgrading it to a company or workshop is subject to review by the platform administration. Each role has separate permissions, and using one role's account to reach another role's data is prohibited.

4. Acceptable and prohibited use

You use the service for its legitimate purposes: finding and ordering parts and services, and listing them if you are a provider. The following are specifically prohibited:

  • Fraud, impersonation, or posting false or misleading information.
  • Manipulating ratings, followers, or any trust signal on the platform.
  • Listing any good or service that is unlawful in Iraq.
  • Creating an offer on a product you do not own, or advertising a discount that does not reflect a real previous price.
  • Attempting unauthorized access to other users' data or to the app's systems.
  • Misusing the contact channels, or harassing users or providers.

5. Company responsibility for products

The company alone is responsible for its products: description, price, availability, quantity, authenticity, and conformity with the specifications it publishes.

Yimken does not manufacture, inspect or warrant the parts listed.

6. Workshop and service-provider responsibility

The workshop or provider is responsible for workmanship, the services and packages it lists, its scheduling, and its published prices.

Any warranty on the work is given by the provider itself, not by Yimken.

7. Crane requests and driver responsibility

  • The crane driver is responsible for safe transport, for the roadworthy condition and documentation of the vehicle, and for compliance with traffic law.
  • A platform commission of 10% of the trip value applies to the driver, and their dues are managed through the in-app settlement mechanism.
  • Performing trips outside the app in order to avoid the commission is prohibited.

8. Yimken as an intermediary

Yimken is a technical intermediation platform that facilitates contact and ordering between the parties, and is not a party to the sale or service contract. The contract is formed directly between the customer and the provider.

The marketplace commission on customer orders is 0% (zero); Yimken takes no percentage of product value on store orders.

9. Payments, cancellation and refunds

  • The app does not currently process electronic payments or automated refunds. Financial settlement happens directly between the customer and the provider.
  • Delivery fees are shown to the customer clearly before an order is confirmed, and the final total is: items subtotal − discount (if any) + delivery fee. Store pickup carries no delivery fee.
  • Every confirmed order keeps the fee calculated for it at the time of confirmation, so later price changes never affect past orders.
  • A customer may cancel a crane request before it is assigned or before the trip starts, according to the state shown in the app; cancellation is final.
  • Cancellation or return of product orders is agreed between the customer and the company.

10. Disputes

Any dispute over a product or service is between the customer and the provider. Yimken assists within the limits of what the app provides — order records and contact channels. You may raise a report through the official support channel, and the platform administration may take action against accounts in breach.

11. Subscriptions and offers

  • Monthly subscription plans are available to companies and workshops. Each plan carries quantitative limits on products, services, offers or reminders, and those limits are enforced automatically.
  • When a subscription ends, the account returns to the free-plan limits.
  • Plan prices and limits are published inside the app, and are the authoritative reference for any active subscription.
  • Offers must be genuine and not misleading, and no party may create an offer on a product it does not own.

12. Intellectual property

The Yimken name, logo, interfaces and software belong to the app operator and may not be copied or reused without permission.

Content uploaded by providers (images and descriptions) remains theirs; they grant Yimken the right to display it in the app for the purpose of operating the service.

13. Service availability

The app is provided as is, and Yimken makes reasonable efforts to keep the service available and the displayed information accurate. We may add, change or discontinue features, and the service may be temporarily unavailable for maintenance or for reasons beyond our control.

14. Limitation of liability

Yimken is not liable for the quality of goods or services supplied by another party, nor for indirect damages arising from use of the app, to the extent permitted by applicable Iraqi law.

Nothing in this clause limits any right that cannot lawfully be waived.

15. Suspension and termination

Any account that breaches these Terms or endangers users may be suspended or terminated.

You may also delete your own account from account settings, subject to the outstanding obligations shown in the app. See the user data deletion instructions.

16. Changes to these Terms

We may update these Terms. The version number and effective date are published at the top of this page, and continuing to use the service means you accept the updated version.

17. Governing law

These Terms are governed by the laws of the Republic of Iraq, and the Iraqi courts have jurisdiction over any dispute arising from them.

18. Contact
